FAQs
Is the mediation agreement legally binding?
The agreement becomes legally binding once it is filed with a court by an attorney. If a party does not uphold their portion of the mediation, a judge can find them in contempt.
DOES THE MEDIATOR MAKE THE final decision?
No. The mediator facilitates the conversation and moves the parties toward resolution. But the mediator is neither a judge nor an attorney and makes no final decisions.
what if i don’t want to speak with the other party present?
Upon request, mediations can be held in caucus in which the mediator speaks to each party privately while the other party waits in a separate, encrypted break out room. The mediator will only share information that the party says is okay to share.
can i bring anyone to the mediation?
Unless otherwise discussed, only the immediate parties and their attorneys are permitted in the mediation. If other parties are needed, please let your mediator know at least one week in advance of the mediation.
can my attorney do all the talking?
Yes. HOWEVER, as in all things with life, we get what we put into the process. So, the more engaged each party is, the stronger the outcomes can be.
What if i don’t have an attorney?
Attorneys are not required at mediation. You are welcome to attend with or without representation. If the other party has representation and you prefer to delay mediation in order to secure your own, just let your mediator know.
